Frequently Asked Questions About Estate Planning & Business Law in Milwaukee

 Is parking free?

Yes, parking is free! Our building has underground parking that we validate for all our clients. Before you come to our office, just have your license plate number on hand.

Do you offer free consultations?

We do offer free 15-minute consultations. If a deeper discussion is needed, we can arrange for a one-hour consultation for a flat fee.

Can you help with clients who live outside of Milwaukee?

Yes, we service clients across southeastern and central Wisconsin. Depending on your location, we often can come to your home to execute a signing.

Should I do a will or trust?

Everyone’s situation is unique. Some situations raise the need for a trust and some do not. We are happy to hear about your needs and interests and develop the best recommendations!

How do I get started with estate planning? What does the process look like?

We start with a consultation either in-person or over the phone; (2) we gather relevant information and documents; (3) our attorneys draft your estate planning documents and send them to you for review; and finally (4) we meet to sign your finalized documents.

I know that some documents require witnesses during the signing execution. Do I have to bring my own witnesses?

If your signing takes place at our office our staff members will serve as your witnesses. If your signing takes place at your home or a third-party location sometimes we can schedule our staff members to be present for such meetings, but sometimes it may be necessary to provide your own witnesses. This is something your assigned counsel will discuss with you before the signing appointment is scheduled.

Can you review or update an existing estate plan?

Yes. We routinely review the client’s existing estate plan to determine if there are gaps in the governing documents and if the documents need to be updated to reflect changes in the law or the client’s personal circumstances or goals. When we make these determinations, we can make the appropriate updates.

Can you help with Medicaid planning and nursing home issues?

Yes! Our team has extensive experience in implementing asset protection strategies, preparing Medicaid applications, and directing clients on how they can maintain eligibility upon becoming eligible. As for nursing homes, we also do long-term care planning and have relationships with many trusted long-term care providers in Wisconsin.

Can you help if there’s a dispute over a will or trust?

MWC has extensive experience in probate and trust administration disputes. Our litigators can assess your case and help you resolve the dispute in court or by mediation and negotiation.
