Title 19 and IRAs

May 21, 2018 by Moertl, Wilkins & Campbell, S.C.

What happens if your spouse enters a nursing home?  What assets are protected for you?  Will you still be able to afford to live independently?

Chances are that you will receive a lot of incorrect information.  An example of this incorrect information relates to your spouse’s IRA accounts.  You may be told that your spouse’s IRA must be spent on his care and that there is no way to preserve your spouse’s IRA to benefit you.  This is wrong.  There are many planning opportunities available to preserve assets even after your spouse has entered the nursing home facility.
